Acceptance of Terms

By using the services of Sea Cargo Logistics Sdn. Bhd. or submitting an enquiry to us, you agree to be bound by these terms and conditions.

Our Services

We provide vehicle and cargo shipping by RoRo (Roll-on/Roll-off) sea route between Peninsular Malaysia, Sabah and Sarawak. All bookings are subject to vessel space availability and sailing schedules.

Quotes & Bookings

Quotes provided are estimates based on the information you supply and are valid for a limited period. The final price is subject to confirmation, the accuracy of vehicle/cargo details, and sailing availability. A booking is confirmed only once agreed by both parties.

Customer Responsibilities

You are responsible for:

  • Providing accurate and truthful information about your vehicle or cargo;
  • Ensuring the vehicle is in drivable condition, with minimal fuel (about a quarter tank) and no valuable or loose personal items inside;
  • Providing valid documents (vehicle registration, identification, and any relevant permits);
  • Declaring cargo contents honestly and complying with applicable laws.

Delivery & Transit Time

Stated schedules and transit times are estimates only. They are subject to weather, tides, port congestion, vessel schedules and other operational factors. We are not liable for delays arising beyond our reasonable control.

Liability & Cargo Carriage

Carriage of cargo under a bill of lading is subject to the Carriage of Goods by Sea Act 1950 (Act 527). Please note that the liability regime differs by port of shipment:

  • Shipments from Peninsular Malaysia are subject to the Hague-Visby Rules (in force from 15 July 2021);
  • Shipments from Sabah and Sarawak remain subject to the original Hague Rules 1924.

Our liability is limited in accordance with those applicable rules. We are not responsible for loss or damage caused by circumstances beyond our control, pre-existing defects in the vehicle, or inaccurate information provided by you.

Marine Insurance

Marine Insurance is a protection plan for your vehicle against the risk of loss during transport by sea. The premium is assessed based on the current market value of the vehicle.

Marine Insurance covers your vehicle in the event of a total loss arising from an accident during the voyage. The risks covered are as follows:

  1. Fire and explosion.
  2. The vessel running aground, sinking or capsizing.
  3. The vehicle overturning or shifting during the voyage.
  4. General Average — the fair and proportional sharing of loss among all parties to the voyage where an extraordinary sacrifice or expenditure is intentionally and reasonably made for the common safety, such as jettisoning part of the cargo to save the vessel and the remaining cargo during an emergency at sea. General Average is governed by the York-Antwerp Rules.

In Malaysia, marine-insurance law is based on the principles of the Marine Insurance Act 1906 (United Kingdom), applied through the Civil Law Act 1956 (Act 67), while insurers are regulated under the Financial Services Act 2013 (Act 758). We strongly encourage every customer to protect their vehicle or cargo with adequate marine insurance.

Governing Law

These terms are governed by the laws of Malaysia. Our domestic shipping operates under the Merchant Shipping Ordinance 1952 (Peninsular Malaysia) and the Merchant Shipping Ordinance 1960 (Sabah and Sarawak), regulated by the Marine Department Malaysia. Any dispute is subject to the jurisdiction of the Malaysian courts.

Amendments

We reserve the right to amend these terms from time to time. The latest version will always be shown on this page.
